So what about if my brother have his return itinery scheduled but change it upon entering the USA. If he doesn't hand contained by his I94 on leaving the States how would anybody know when he vanished ?

Do not mail the I-94/I-94W to the Embassy. Doing so will singular delay the update of the departure information. The CBP organization in London cannot update the arrival and departure system.
